Are you a residential leaseholder who wants to extend the term of your lease?
You do not have to accept the freeholder’s terms. You have a legal right to a Statutory Lease Extension under the 1993 Leasehold Reform Housing & Urban Development Act as long as you have owned your property for more than 2 years. This gives you the automatic right to a new lease with an additional 90 years added onto your current, unexpired lease term and also resets the ground rent to a peppercorn (nil) for the duration of the new lease. You do not have to accept inferior terms offered by freeholders such as short lease extensions just back to 99 years or large escalating ground rents or excessive premiums. Are you a prospective purchaser of a leasehold flat with a short lease?
If so, you do not have to accept unreasonable terms from the freeholder for the extension of the lease when you purchase and you can avoid the 2 year ownership rule. An outgoing leaseholder can commence formal proceedings by serving the initial notice for the lease extension and assigning this to you as purchaser so that you can obtain the full benefit of the statutory lease extension with longer term, zero ground rent and reasonable premium. Are you a group of leaseholders wanting to purchase the Freehold of your block?
Groups of leaseholders have a legal right to Enfranchise (forcefully purchase the freehold of their block from their current freeholder) under the 1993 Leasehold Reform, Housing & Urban Development Act. You do not have to have a particular reason and may simply wish to take control of your own property however if you are unhappy with the current standard of maintenance/management or the level of maintenance or insurance charges or your unexpired lease terms are becoming short, then purchasing the freehold may be your best option.
